The failure to enforce or require performance of any provision will not operate as a waiver to enforce or exercise the same or other provision at any later date. In the event any action or proceeding is brought by any party to enforce the terms of the resort stay, or to recover possession of the unit or to enforce any rights, the prevailing party shall recover from the other party their reasonable costs and attorneys’ fees.
